New rules for setting the minimum wage
2024-08-05 10:29

On 22 July this year, the Council of Ministers published the objectives of the Minimum Wage Bill in its schedule of legislative and programme work. The Bill is to transpose Directive (EU) 2022/2041 of the European Parliament and of the Council of 19 October 2022 on adequate minimum wages in the European Union into Polish law.

The Bill:
- lays down the rules and procedure for setting and updating the minimum wage,
- appoints the Social Dialogue Council as a consultative body competent in matters related to setting and updating the minimum wage,
- regulates the reporting of the minimum wage,
- lays down the rules and procedure for setting and paying the minimum hourly rate.

According to the Bill, the minimum wage will be negotiated annually within the Social Dialogue Council. Negotiations will take 30 days of the date of submission of proposals and information by the Council of Ministers.

According to the Bill, the minimum wage will change once or twice a year, depending on the inflation rate. If the price index forecast for the following year is at least 105%, the minimum wage and the minimum hourly rate will change twice, i.e. as from 1 January and 1 July. If the inflation rate is lower, the minimum wage will change only once, i.e. as from 1 January.
